California Buyers Choice Act
The California Buyer’s Choice Act (AB 957) The Buyer’s Choice Act prohibits the seller of a property acquired through foreclosure to require a buyer to purchase title and escrow services from a company of the seller’s choice as a condition to receive offers or sell the property.That doesn’t mean that the buyer can’t accept the seller’s recommendations for a company for their title and escrow. The seller just can’t make it a required for the sale. This new law only applies to residential properties that are improved by four or less units.

California Residential Mortgage Lending Act (CRMLA)
The California Residential Mortgage Lending Act (CRMLA) authorizes licensees to make federally related mortgage loans, to make loans to finance the construction of a home, to sell the loans to institutional investors, and to service such loans. Licensees are authorized to purchase and sell federally related mortgage loans and to provide contract underwriting services for institutional lenders. Licensees are authorized to service any federally related mortgage loan regardless of whether they make the loan or purchase a servicing portfolio. CRMLA licensed lenders are authorized to provide brokerage services to borrowers, by attempting to obtain a mortgage loan on behalf of the borrower from an institutional lender. Employees who engage in brokering activities on behalf of the CRMLA licensee must also be licensed mortgage loan originators.

Civil Rights Act of 1964
The Civil Rights Act of 1964 makes it unlawful to discriminate on the basis of race, color, religion, sex or national origin. This Act applies to any private employer with 15 or more employees in an industry affecting interstate commerce. This would include the real estate industry, since the buyers and sellers are all over, and the marketing for real estate sales is nationwide in most cases.

Community Home Buyer’s Loan (Summary)
Many lenders offer a loan program called a Community Home Buyer’s Loan program which is specifically tailored for the first time homebuyer. This type of loan provides financing for low, to moderate income buyers who might not qualify for a loan on traditional criteria.
Community Reinvestment Act
The Community Reinvestment Act is intended to encourage depository institutions to help meet the credit needs of the communities in which they operate, including low- and moderate-income neighborhoods, consistent with safe and sound operations. It was enacted by the Congress in 1977 (12 U.S.C. 2901) and is implemented by Regulation BB (12 CFR 228). The regulation was substantially revised in May 1995 and updated again in August 2005.

Consumer Credit Protection Act
The purpose of the Consumer Credit Protection Act is to promote the availability of credit to all creditworthy applicants without regard to race, color, religion, national origin, sex, marital status, or age (provided the applicant has the capacity to contract); to the fact that all or part of the applicant’s income derives from a public assistance program; or to the fact that the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The regulation prohibits creditor practices that discriminate on the basis of any of these factors. The regulation also requires creditors to notify applicants of action taken on their applications; to report credit history in the names of both spouses on an account; to retain records of credit applications; to collect information about the applicant’s race and other personal characteristics in applications for certain dwelling-related loans; and to provide applicants with copies of appraisal reports used in connection with credit transactions.
